1. Acceptance of These Terms
These Terms of Service (the "Terms") are a binding agreement between you and Jump Jump Dash LLC ("Jump Jump Dash," "we," "us" or "our"). They govern your use of our website at https://jumpjumpdashco.com (the "Site"), our software applications, including Recer (the "App"), and any related services (together, the "Services").
By creating an account or by accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
Our Privacy Policy explains how we collect and use your information. It is incorporated into these Terms by reference. Please read it.
PLEASE REVIEW THE ARBITRATION AGREEMENT SET FORTH BELOW IN THE ARBITRATION SECTION CAREFULLY. THIS ARBITRATION AGREEMENT WILL REQUIRE YOU TO RESOLVE DISPUTES WITH JUMP JUMP DASH ON AN INDIVIDUAL BASIS THROUGH FINAL AND BINDING ARBITRATION. BY ENTERING THIS AGREEMENT, YOU EXPRESSLY ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND ALL OF THE TERMS OF THIS AGREEMENT AND HAVE TAKEN TIME TO CONSIDER THE CONSEQUENCES OF THIS IMPORTANT DECISION.
2. Eligibility and Accounts
Age. You must be at least 13 years old to use the Services. If you are under 18, or under the age of majority where you live, you may use the Services only with the permission of a parent or legal guardian who agrees to these Terms on your behalf. We may ask you to confirm your age and may restrict or close an account if we believe the user is under 13.
United States only. The Services are intended for use only in the United States. You may not use the Services from outside the United States.
Your account. You need an account to use most features of the App. You agree to:
- provide accurate information when you register and keep it up to date;
- choose a username that does not impersonate another person, infringe anyone's rights, or contain offensive content;
- keep your password and login credentials confidential; and
- tell us promptly at support@jumpjumpdashco.com if you believe your account has been compromised.
You are responsible for all activity under your account. You may have only one account unless we agree otherwise. We may reclaim or change a username that violates these Terms.
Third-party sign-in. If you sign in with a Google or Apple account, your use of that account is also subject to that provider's terms.
3. The Services
What Recer is. Recer lets you keep and share lists of recommendations for movies, television, books, music, podcasts and games, follow other users, bookmark items, and chat with other users in group chats called Clubs.
License to you. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control and to use the Services for your personal, non-commercial use.
Changes and availability. We may add, change, suspend or discontinue any part of the Services at any time, with or without notice. We do not promise that the Services will always be available or that any content will be kept.
Pre-release software. The App is currently offered as a beta. Beta features may contain errors, may change or be removed, and may result in loss of data. Feedback and bug reports you send us are covered by Section 7.
No fees. The Services are currently free. If we introduce paid features, we will present the price and any additional terms before you are charged.
4. Your Content
What counts as your content. "User Content" means anything you post, upload or send through the Services, including your recommendations and lists, profile name, username, bio and photo, chat messages, reports and feedback.
You own it. You keep ownership of your User Content. We do not claim ownership of it.
License to us. You grant Jump Jump Dash a worldwide, non-exclusive, royalty-free, sublicensable and transferable license to host, store, reproduce, modify (for example, to resize or format), display, perform and distribute your User Content, solely to operate, provide, improve and promote the Services. This license ends when you delete the User Content or your account, except that:
- content you shared with others (such as chat messages in a Club) may remain visible to them;
- copies may remain in backups for a limited time; and
- we may keep content where the law requires or permits it, as described in the Privacy Policy.
Your promises. You represent that you have the rights needed to post your User Content and to grant the license above, and that your User Content does not violate these Terms, the law, or anyone's rights.
Public content. Your profile, recommendations and lists may be visible to other users. Do not post anything you want to keep private.
No obligation to monitor. We are not required to review User Content and are not responsible for content posted by users. We may remove or limit any User Content at any time, for any reason, including if we believe it violates these Terms.
5. Acceptable Use
You agree not to, and not to help anyone else to:
- harass, threaten, bully, stalk or abuse any person;
- post content that is unlawful, hateful, sexually explicit, violent, defamatory, or that exploits or endangers minors;
- impersonate any person or entity, or misrepresent your age or identity;
- post spam, advertising or promotions, or use the Services for any commercial purpose without our written permission;
- infringe anyone's copyright, trademark, privacy, publicity or other rights;
- collect or harvest information about other users, or use the Services to contact users outside the features we provide;
- scrape, crawl or use bots or other automated means to access the Services;
- reverse engineer, decompile or attempt to extract the source code of the App, except where the law allows it despite this restriction;
- interfere with, disrupt or overload the Services, bypass security or access controls, or probe for vulnerabilities without our written permission;
- use the Services from outside the United States, or evade our age, location or account restrictions, including by creating a new account after being suspended; or
- use the Services in violation of any law.
Reporting. You can report users or content that you believe violate these Terms using the reporting tools in the App or by contacting us at support@jumpjumpdashco.com.
Enforcement. If we believe you have violated these Terms, we may remove content, limit features, or temporarily or permanently suspend your account. Where we offer an appeal process in the App, you may use it to ask us to review a decision. Our decision after review is final.
6. Third-Party Services and Content

7. Intellectual Property
Our rights. The Services, including the App, the Site, their software, design, text, graphics and logos, and the names "Jump Jump Dash" and "Recer," are owned by Jump Jump Dash or its licensors and are protected by intellectual property laws. 9. Disclaimers, Limitation of Liability and Indemnity
Disclaimer of warranties. THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, JUMP JUMP DASH DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. Some states do not allow certain warranty disclaimers or liability limits, so some of the above may not apply to you. In those states, our liability is limited to the fullest extent the law permits.
Indemnity. To the extent permitted by law, you agree to indemnify and hold harmless Jump Jump Dash and its owners, employees and agents from any claims, losses, damages, liabilities and expenses, including reasonable attorneys' fees, arising from your User Content, your use of the Services, or your violation of these Terms or of any law or third-party right.
10. Arbitration, Applicable Law, Choice of Venue, Jurisdiction, and Fee-Shifting.
Informal resolution first. Before filing a claim, you agree to contact us at legal@jumpjumpdashco.com and try to resolve the dispute informally. If we cannot resolve it within 60 days, either of us may bring a formal claim.
Time limit. To the extent permitted by law, any claim must be filed within one year after it arises, or it is permanently barred.
Arbitration, Individual Arbitration and Acknowledgments. Any controversy or claim arising under, out of, or in relation to these Terms or the use of Jump Jump Dash’s Services, or any breach or asserted breach thereof, shall be settled by binding arbitration in Sonoma County, California, with a preference for remote arbitration where practicable, subject to the conditions and exclusions of this section.
You hereby acknowledge and agree that you and Jump Jump Dash are each waiving the right to a trial by jury or to participate as a plaintiff or class member in any purported class action or representative proceeding. Unless both you and Jump Jump Dash otherwise agree in writing, any arbitration will be conducted in English by and in accordance with the rules and procedures of JAMS, as modified by this section. Disputes will be arbitrated only on an individual basis and will not be consolidated with any other arbitrations or other proceedings that involve any claim or controversy of any other party.
Unless otherwise agreed by the parties, the arbitration panel shall consist of one arbitrator chosen in accordance with the rules of JAMS. Any such arbitrator shall be knowledgeable in the subject area in which the dispute arises. All discovery shall be completed within sixty (60) days following the appointment of the arbitrator. Each party shall be entitled to representation by counsel, to appear and present written and oral evidence and argument and to cross-examine witnesses presented by the other party, provided that, where appropriate, the arbitrator may receive testimony via telephone, video or other electronic means of communication. The arbitration award shall be in writing. The award of the arbitrator shall be final and binding on the parties hereto and may be enforced in any court of competent jurisdiction. The parties waive any right they may have to an appeal of the arbitrator’s decision and/or award. The prevailing party in any action or proceeding to enforce its rights under these Terms or related to the Services shall be entitled to recover reasonable attorneys’ fees and other reasonable costs, including fees of the arbitrator and the JAMS, incurred in the action or proceedings. In no event shall the arbitrator award punitive or exemplary damages. The parties waive any right they may have to an appeal of the arbitrator’s decision and/or award. Each party retains the right to seek judicial assistance: (i) to compel arbitration, (ii) to obtain interim measures of protection prior to or pending arbitration, (iii) to seek injunctive relief in the courts of any jurisdiction as may be necessary and appropriate to protect the unauthorized disclosure of its proprietary or confidential information; (iv) for any claims of infringement or misappropriation of patent, copyright, trademark, or trade secrets; and (v) to enforce any decision of the arbitrator, including the final award.
Applicable Law. These Terms of Service shall be construed in accordance with and governed by the laws of the United States and the State of California, without reference to rules regarding conflicts of law.
Exclusions. You hereby acknowledge the following exclusions to these terms regarding arbitration.
- You and Jump Jump Dash both retain the right to bring an individual action in small claims court
- You and Jump Jump Dash both retain the right to seek equitable relief in a court, chosen in compliance with these Terms, solely to prevent the actual or threatened infringement, misappropriation or violation of a party's intellectual property rights, including but not limited to copyrights, trademarks, trade secrets, and patents.
Admissibility. A printed version of these Terms and of any notice given in electronic form will be admissible in judicial or administrative proceedings based upon or relating to these Terms to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
Jurisdiction and Choice of Venue. You acknowledge that all claims or controversy shall be settled by arbitration according to this Section. However, you additionally hereby irrevocably consent to the exclusive jurisdiction of the state or federal courts located in the Northern District of California, in all disputes arising out of or related to the use of the Site or Service, that, for any reason, are not arbitrated.

Severability. If any part of these Terms is found unenforceable, the rest remains in effect.
No waiver. Our failure to enforce any part of these Terms is not a waiver of our right to do so later.

Notices. We may send you notices through the App or to the email address on your account.
